Florian Jenal examines the procedural rights of people injured by criminal offences who participate as private claimants under Swiss criminal procedure. The German-language monograph gives particular attention to rights directed toward the determination of guilt, including avenues of appeal and other legal remedies.
The analysis asks how those rights are justified and how their exercise relates to the internationally and constitutionally protected interests of an accused person. It considers whether the resulting balance calls for changes to Swiss procedural law.
A further discussion examines consensual methods of resolving criminal disputes under the heading of restorative justice. The complete first edition retains the original legal authorities, detailed references and bibliography.
